H.I.E's Liability Waiver

NOTICE: It is wise to seek your doctor’s advice before beginning any health, fitness or nutritional program.

This agreement is entered into between the undersigned and Health Inspired Essentials and its owner/trainer.

Health Inspired Essentials provides a fitness opportunity to all fitness levels to work out virtually and gain from the experience. I acknowledge and agree to the following:

  • I acknowledge that the owner/founder/trainer of Health Inspired Essentials is NOT a physician and is not trained in any way to provide medical diagnosis, medical treatment, or any other type of medical advice.

  • I acknowledge that coaching training is one of many tools for teaching athletes/individuals about themselves, but that Health Inspired Essentials does not guarantee the training given by any trainer will produce any particular result.

  • I acknowledge that if I feel tired, pain or out of the ordinary in any way, that I should contact a physician at once. I acknowledge that I am fit and have a regular physician I can contact regarding any medical problems that might develop.

  • RELEASE OF LIABILITY: I acknowledge that any physical activity or any exercise conducted on my behalf carries a potential for damage or loss of property, serious injury or death. I assume the risks of participating in these types of activities. Further, I expressly waive, release and hold Health Inspired Essentials from all claims, injuries, and damages arising out of or connected to my participation in Health Inspired Essentials virtual fitness training.

  • I agree to keep confidential all services provided by Health Inspired Essentials.

  • I agree that videos and photos may be taken through the recorded sessions for training and teaching purposes of the business. I release any rights I have in these videos and photos and authorize Health Inspired Essentials to use them for commercial, training, or other purposes.

  • Limitation of Actions and WAIVER of JURY TRIAL. I agree to bring all claims that in any way relate to or arise out of this agreement, Health Inspired Essentials training or any of the dealings of the parties “claims”, if at all, within 6 months of the occurrence of the facts giving rise to such claims, and that any action not brought within this period shall be barred as a claim, counterclaim, and defense, or set-off. I agree to waive my right to a jury trial, to seek or recover punitive damages, and I agree to bring any claim, individually, and not participate in a class action against Health Inspired Essentials.

  • I agree this is the full agreement between the parties, that Health Inspired Essentials has not contradicted any of the terms of this agreement and I am entering into this agreement freely and voluntarily without force or coercion.

  • I acknowledge that no form of refund will be given.

  • I understand that after my trial period, if I do not cancel before it is over, I will be charged for the monthly membership with no reimbursement and will have access to all classes and materials until membership is cancelled. 

  • You may cancel at any time before the next month’s reoccurring monthly charge. Once you cancel your membership, you have access to all classes and materials until your monthly renewal date.

  • I understand that diet and nutrition will greatly affect my fitness goals and performance.

  • I agree to all Terms and Conditions listed above and I am the applicant.
